Goods Sold As Seen

Implied warranties can be excluded by describing the product with language such as:

Sold as seen

Sold as is

With all faults.

This means that the products are sold ‘Untested” and are without Warranty.

These items are generally sold at a lower price as they come with no warranty.


Goods Sold As Seen – Uniform Commercial Code (UCC)

The UCC (Article 35) states that:

“The seller is not liable…for any lack of conformity of the goods if, at the time of the conclusion of the contract, the buyer knew or could not have been unaware of such a lack of conformity.”
